New Laws Impacting Residential Zoning and Development

The Governor signed Senate Bills 8, 9, and 10 into law with the intent to expand housing production in California. These bills have been characterized as “the end of single-family zoning” and will expedite the permit process for landowners to build additional dwelling units (ADUs). 

The new laws became effective January 1, 2022, but the following (and not limited to) can prevent ADU construction pursuant to the new laws: 

1. Habitats / protected species / wetlands

2. Land within the 100-year floodplain or a floodway

3. Prime farmland or farmland of statewide importance

4. Very high fire hazard severity zones

5. Historic or landmark districts under state or local law

6. Land under a natural community conservation plan, or land under conservation easement
